TERMS OF SALES
PREAMBLE
The lachemise.club website (hereinafter referred to as “the Site”) is published by the association La Chemise Club, an association under the 1901 law, whose head office is at 2 rue Saint-François 33300 Bordeaux.
These General Conditions of Sale are intended to define the rules applicable in the context of the sale of products marketed on the Site (hereinafter “the Product(s)”),

Any adult natural person, non-commercial, having the legal capacity to contract, exclusively domiciled in the countries delivered by lachemise.club (hereinafter "the Customer") making a purchase of Product on the Site.
For the application hereof, it is agreed that the Customer and La Chemise Club will be collectively referred to as the “Parties” and individually referred to as the “Party”.
These general conditions (hereinafter the "General Conditions of Sale") govern without restriction the sales of Products made by La Chemise Club from the Site.
La Chemise Club reserves the right to modify these General Conditions of Sale at any time by publishing a new version on the Site. The applicable General Conditions of Sale are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full acceptance of the General Conditions of Sale in force at the time of placing the order.
ARTICLE 1: OBJECT
The purpose of these General Conditions of Sale is to define the conditions under which the Products are marketed by La Chemise Club to the Customer. They thus regulate the different stages of completing the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.
ARTICLE 2 • THE OFFER
- If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.
- The offer is without obligation. The La Chemise Club association has the right to modify and adjust the offer.
- The offer contains a complete and precise description of the products and/or services offered. The description is sufficiently detailed to allow a correct evaluation of the offer by the consumer. If the La Chemise Club association uses images, they are a faithful representation of the products and/or services offered. Obvious errors or errors in the offer do not bind the La Chemise Club association.
- All images, specifications, data in the offer are indicative and cannot give rise to any compensation or termination of the contract.
- Product images are an accurate representation of the products offered. The La Chemise Club association cannot guarantee that the colors displayed correspond exactly to the actual colors of the products.
- Each offer contains information such that the consumer clearly knows what rights and obligations attach to its acceptance. This concerns in particular:
- the price including taxes;
- possible shipping costs;
- how the agreement will be concluded and what actions are necessary for this purpose;
- whether the right of withdrawal is applicable or not;
- the method of payment, delivery and implementation of the agreement;
- the deadline for acceptance of the offer or the period within which the entrepreneur guarantees the price;
- the way in which the consumer, before concluding the contract, can check the information provided by him under the contract and, if necessary, restore it;
- any other language in which the agreement can be concluded in addition to French
ARTICLE 3 • PRICE
Prices are indicated in euros, all taxes included (the invoice will be expressed in euros), excluding delivery costs; it being specified that the value added tax is that in force on metropolitan French territory on the day of validation of the order.
The prices applied are those communicated on the Site and confirmed to the Customer when validating the order.
The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed all taxes included (value added tax applicable in France). These costs are the responsibility of the Customer and are invoiced in addition to the sale price of the Products.
The transfer of risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer.
ARTICLE 4 • ORDERING AND PAYMENT OF PRODUCTS
4.1 ORDERING
The Customer completes his order by completing the following 5 steps:
Step 1: the Customer selects the chosen Products and adds them to his basket after having selected, where applicable, the desired size and color.
The basket located at the top right of the screen informs the Customer that he has taken into account the selections by indicating the number of Products it contains.
Step 2: the Customer checks the contents of his basket by clicking on “order” in order to have access to the summary of his order. The Customer can then modify his order (Product, size, quantity).
Step 3: once the order has been verified and, if necessary, modified, the Customer validates their basket in order to finalize their order by clicking on “order” again.
If the Customer has an advantage code, reserved for the best Customers, he must enter it in the space provided for this purpose in order to benefit from it.
Step 4: entry by the Customer of delivery and billing details.
Apart from the date of birth, additional address and delivery information, all fields are necessary to finalize the order; it being specified that unless otherwise indicated by the Customer, the billing address will automatically be the same as the delivery address.
Once the delivery address has been validated, the total amount including tax of the order, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary.
If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will identify himself only with his email address and password.
The Customer then checks all the information and clicks on “validate” to continue with their order.
The Client expressly undertakes to communicate complete and accurate information. In the event of an error in the wording of the delivery address or incomplete information making delivery of an order impossible, the La Chemise Club association cannot be held responsible.
Step 5: Entering bank details
The Customer will then access the secure payment screen of the partner of the La Chemise Club association as specified in article 4.3 below.
Payment is made online by one of the following payment methods: Carte Bleue, Visa or Coinbase.
The Customer must enter their bank card number, its expiry date as well as the 3 numbers of the visual cryptogram present on the back of their card.
If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.
In the event of payment failure, the Customer will have up to 3 attempts to re-enter their bank details. At the end of the 3rd refusal, the Customer will be redirected on the Site to a screen indicating the refusal of payment. The Customer will then be invited to contact the customer service of the La Chemise Club association to find out the reasons and together find a solution to finalize the Customer's order.
4.2 ORDER CONFIRMATION
Upon acceptance of the Customer's payment, the Customer will receive an e-mail confirming his order, summarizing all the items ordered, the billing and delivery address and the delivery date.
The validation of the order by the Customer and the order confirmation sent to the Customer by email by the La Chemise Club association following acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale. Sale.
The Customer who has placed an order will have the possibility of printing his invoice by connecting to the Site in the order tracking area provided for this purpose.
The La Chemise Club association reserves the right not to validate the order in the event of:
abnormal or abusive claims,
abnormal orders with regard to the quantities ordered,
abnormal or abusive exchanges and returns,
existing dispute(s) with the customer.
The customer service of the lachemise.club site is available to the Customer for any questions relating to their order. Customer service is available by email (coucou@lachemise.club) from Monday to Friday, from 10 a.m. to 6 p.m. (GMT time zone +1 hour and except public holidays in France).
4.3 PAYMENT
The price of the Products purchased is payable in full in cash on the day the order is placed by the Customer. Payment is made online using the following payment methods (Carte Bleue, Visa, Coinbase) at the time of validation of the order by the Customer.
The transactions carried out on the Site are secured by the payment system of the partner of the La Chemise Club association, Stripe, recognized by the main players in the financial world. Stripe being a technical service provider, it does not support disputes related to orders which are handled directly by the La Chemise Club association as specified above or, where applicable, by the Customer's bank.
The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. The La Chemise Club association reserves the right to proceed with a new direct debit authorization request in the event that the first could not be completed due to the unavailability of the servers.
In the event of non-payment, an incorrect address or any other problem on the Customer's account, the La Chemise Club association reserves the right to block the Customer's order until the problem is resolved.
In the event of fraudulent use of his bank card on the Site, the Customer is invited to contact by email at the following address: commands@lachemise.club
Transactions carried out on the Site are secured by the payment system of the partner of the La Chemise Club association, the company Stripe.
All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time does the Customer's financial data pass through the computer system of the La Chemise Club association. Stripe verifies that the connection with the Customer's browser is secure before sending the payment form to the banking institution carrying out the financial transaction.
4.4 ARCHIVING THE ORDER
The order confirmation is recorded in the records of the La Chemise Club association, which are themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation is authentic and considered as proof of the contractual relations between the Parties.
ARTICLE 5 • DELIVERY
The La Chemise Club association undertakes to make its best efforts to deliver the products ordered within the deadlines indicated when confirming the order. In order for these deadlines to be met, the Customer must ensure that they have provided accurate and complete information regarding the delivery address.
The Customer will be informed by email as soon as possible of any possible delivery delay. In such a situation, he will also be informed by email of the new delivery times.
Delivery times vary depending on the availability of the products ordered, the delivery location and the delivery method chosen.
Shipping Policy
Order processing times are separate from delivery times.
All orders are processed within 1 to 2 business days (excluding weekends and public holidays) after receiving your order confirmation email. You will receive a new notification when your order has been shipped.
Potential delays due to high volume of orders or postal service issues that are beyond your control are possible; La Chemise Club will do its utmost to inform customers before placing their order.

You can avoid shipping costs with free local pickup at La Chemise Club.
After placing your order and selecting in-store pickup, your order will be prepared and ready for pickup within 1 to 2 business days. We will send you an email when your order is ready, along with instructions for arranging an appointment for collection.

Your order may be subject to import duties and taxes, which are incurred once the shipment reaches your destination country. La Chemise Club is not responsible for these charges if they are applied and are your responsibility as a customer.
How can I check the status of my order?
When your order ships, you will receive an email notification from us that will include a tracking number that you can use to check its status. Please allow 48 hours for tracking information to be available.
If you have not received your order within 3 days of receiving your shipping confirmation email, please contact us at orders@lachemise.club with your name and order number, and we will will review for you.
Refunds, returns and exchanges
Our returns policy:
We accept returns up to 14 days after delivery, if the item is unused and in its original condition, and we will refund the full order amount. Return shipping costs are the responsibility of the customer.
In the event that your order arrives damaged, please email us as soon as possible at orders@lachemise.club with your order number and a photo of the item. We will handle these matters on a case-by-case basis, but will do our best to find a satisfactory solution.

ARTICLE 6 • RECEIPT OF THE ORDER – COMPLAINTS – RETURNS
Article 6.1
The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning delivery such as:
damaged package,
missing products,
damaged products,
products not conforming to the order,
must be notified within 24 hours of receipt of the order.
This notification will be sent to the site's customer service either by registered mail, by writing to the following address:

After this period, no complaints will be accepted by the La Chemise Club association, the Products being then deemed to be compliant.
For any return of non-compliant Product, the Customer must respect the following procedure:
the Customer must attach to their package the return form previously completed and printed using the return form accessible from the customer area – “My Orders” section. No returns will be accepted without said return slip duly completed.
the Products must be returned in their original packaging, with their label and any accessories allowing their re-marketing, to the following address:

In the event of an incomplete or damaged return, a refund will not be accepted.
The risks and return costs are the sole responsibility of the Customer.
When non-compliance has been noted, La Chemise Club will offer the Customer either:
the replacement of the Product(s) at the expense of La Chemise Club, or
reimbursement of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-compliant Product up to the price list (Colissimo delivery without registered mail) displayed by Colissimo and Colissimo International on March 1 of the current year, at the latest within thirty (30) days from the date of sending the notification of confirmation of non-compliance by the customer service of the com site.
In the event of non-compliance, La Chemise Club will reimburse all products rendered non-compliant, as well as shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery.
Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, La Chemise Club will reimburse the postal return costs up to the price list (Colissimo delivery without registered mail) displayed by La Poste on March 1 of the current year. The Customer must send proof of the return costs incurred to Customer Service, by email or by post.
In the event of abnormal or abusive complaints, La Chemise Club may refuse to serve a subsequent order.
The return of certain types of goods is not permitted. Thus, newspapers or magazines cannot be returned.
Other items not permitted for return:
* Gift Cards
To complete your return, we require a receipt or proof of purchase.
In some cases, only partial refunds are given: (if applicable)
* Books showing obvious signs of use
* Any item that is not in its original condition, that is damaged for any reason not due to error on our part.
* Any item returned more than 14 days after delivery
Refunds (if applicable)
Once your return has been received and inspected, we will email you to let you know that we have received the returned item. We will also let you know if your refund is approved or denied.
If approved, your refund will then be processed and your original credit card or payment method will be credited automatically within a few days.
Delayed or missing refunds (if applicable)
If you haven't received a refund yet, first double-check your bank account.
Then contact your credit card company, as it may take some time for your refund to appear officially.
Then contact your bank. The posting of a refund is often preceded by a processing time.

Sale or promotional items (if applicable)
Only regular priced items are refundable. Unfortunately, sale or promotional items are not.
Exchanges (if applicable)
We only replace items that are initially defective or damaged. If you need to replace yours with the same item, send us an email to commands@lachemise.club and send your item to: 2 rue Saint-François, Bordeaux, 33000, France.
Gifts
If the item was marked as a gift at the time of purchase and shipped directly to you, you will receive a gift credit equal to the value of the returned item. Once the returned item is received, a gift voucher will be sent to you by post.
If the item was not marked as a gift at the time of purchase, or if the gift giver had the order sent to them with the intention of giving it to you later, it is her that we will send the refund and she will therefore know that you have returned her gift.
Shipping
To return your product, you must send it to the following postal address: 2 rue Saint-François, Bordeaux, 33000, France.
Shipping costs associated with returning your item are your responsibility. They are not refundable. If you receive a refund, the return shipping cost will be deducted.
Depending on where you live, the time it takes to receive your exchanged product may vary.
If you are shipping an item worth more than €40, we recommend using a trackable shipping service or insuring your shipment. We do not guarantee that we will receive the returned item.
ARTICLE 7 • RIGHT OF WITHDRAWAL
1- Your right of withdrawal
You have the right to withdraw from your order without giving any reason within 14 days from the day of payment of the order.
For any order of non-perishable products, you have 14 days to exercise your legal right of withdrawal from receipt of your order. To exercise your right of withdrawal, in accordance with legal provisions, you can write us an email to commands@lachemise.club.
You then have 14 days after activating your right of withdrawal to return the product.
2- Conditions for exercising the right of withdrawal
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this order by means of an unambiguous declaration (postal letter, email). You can write to us at commands@lachemise.club. or send us your notice of withdrawal by post to the address below:

For a return of non-perishable products (which must be in good condition), our Customer Relations department will respond to you as soon as possible and will specify the steps to follow as well as the return address for the products.
You will have to cover the direct costs of returning the product. You must return the product no later than 14 days after you have communicated to us your decision to withdraw from this order. Exercising the right of withdrawal gives rise to a refund of the sums paid when ordering as soon as possible and at most no later than 14 days from the date you exercised this right. Only the price of the products and the shipping costs will be reimbursed, the return costs remaining at your expense. We will process the refund using the same payment method you used for the initial transaction. This reimbursement will not incur any costs for you. We may withhold reimbursement until we have received the product. It is however specified, in the event of total or partial payment by gift vouchers, that these cannot be reimbursed either in cash, by check, or by bank card. Reimbursement of purchases made by gift vouchers will be made exclusively in the form of gift vouchers for an amount identical to that paid in this form.
Exceptions to the right of withdrawal after an online purchase
Article L121-21-8 of the Consumer Code lists all exceptions to the right of withdrawal. So, for example, for CDs, DVDs, or software, it is not possible to obtain a refund if the packaging has been removed. The same applies to hygiene or health products that have been unsealed (protective plastic film removed). In the case of trips purchased online, perishable goods (food, plants, cut flowers for example) or made to measure, there is no right of withdrawal.
However and exceptionally, if your order has not yet been dispatched, and after agreement from customer service, your order may be cancelled. Please note that a 5% deduction will be made for bank fees and commissions charged for each transaction.
Your refund will not be full because we will charge administration fees covering in particular the bank charges that we paid when taking your order.
ARTICLE 8 • LIMITATION OF LIABILITY
Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or information transfers, the risks of cut, the risks of contamination by viruses circulating on the network and in general all the risks related to the use of the Internet network.
La Chemise Club can therefore in no way be held liable for any direct or indirect damage resulting from misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunction of the servers, the telephone line or any other technical connection, the Customer's connection to the Site being made under his full responsibility.
ARTICLE 9 • FORCE MAJEURE
La Chemise Club will not be liable for the total or partial non-execution of its obligations under the order placed by the Customer, if this non-execution is caused by an event constituting a case of force majeure as defined by positive law.
In such a case, La Chemise Club will inform the Customer of the occurrence of such an event within 3 (three) clear days following its occurrence, by e-mail.
After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be canceled and will, if necessary, be reimbursed by La Chemise Club on the bank card used to place the order within a maximum period of 30 (thirty) days.
ARTICLE 10 • APPLICABLE LAW
If any of the terms of these General Conditions of Sale are found to be null, illegal or unenforceable by court decision, the other provisions of the General Conditions of Sale will remain in force.
The General Conditions of Sale are executed and interpreted in accordance with French law.
In the event of a dispute, the customer should contact La Chemise Club as a priority to obtain an amicable solution and in the absence of an agreement, the Bordeaux Commercial Court will have sole jurisdiction.
